David Loschiavo   To use TapTheHive (hereinafter "TTH") you must agree to the following.

Usage Eligibility

Age Limit. You may not use TTH if you are under the age of 18.

Location. You are not authorized to use TTH if you reside in, are a citizen of, resident of, domiciled in, or presently located in the State of Texas or the State of New York.

Privacy

Protocol Data. As with the operation of any website, TTH receives various operational pieces of data including but not limited to your IP address (which can roughly estimate which computer you are accessing the internet from), access times, session IDs, and numerous other portions of data necessary to deliver data to you on the HTTP level.

Usage and Submitted Data. Throughout usage of TTH, various usage statistics are logged, including but not limited to, clicked links and buttons, error messages, times on various pages, and text typed into forms.

Email. Your email address is not required to create an account, but if you do not submit it, you cannot use the password reset function. TTH will not knowingly and intentionally share your email address. Passwords cannot be retrieved (they're stored via one-way encryption) and passwords will NOT be reset except through the automated reset process (which requires that you submit a working email address).

TTH will never sell, rent, trade, or otherwise intentionally disclose your email address to anyone except in accordance with a valid legal request.

TTH will not email you except in the following situations:
  • You have directly ordered TTH to email you (like when you receive a message, or daily feed updates, etc.). These settings are all disabled by default and require action by you for us to email you. You don't have to opt-out of anything -- it's all opt-in.
  • You have been incredibly inactive. If you have been inactive for 270 days, TTH will send you an email stating that you have been inactive and your account is coming up for involuntary deletion for inactivity. You will receive the same email again at 300 days, 330 days, 345 days, and 365 days. If you have not logged in by the end of the 365th day, your account will be deleted.
  • Your account has been used unlawfully or in violation of these Terms and Policies.

Legal Requests. TTH reserves at its sole discretion the right to oppose or comply with any subpoenas, executive requests, or order of any court of competent jurisdiction. TTH makes absolutely no warranty that any such demand or request for information will be opposed or complied with.

Data Retention. The above-mentioned data is logged, and may be kept well in excess of 30 days. TTH makes absolutely no warranty that such data will be erased, made inaccessible, or kept accessible after any given period.

Advertisements. TTH is ad supported through third party advertising affiliates, and your usage may be cross referenced and tracked based on these affiliates' models. Some of these may formulate and retain a profile on your browsing habits to tailor advertisements more towards your interests. TTH has no control over what data these affiliates retain, and it may be retained indefinitely.

Intellectual Property

Submitted Content. Anything you post to TTH, including but not limited to posts, comments, messages, chatter, tags, and trails is referred to as "submitted content." Unless you explicitly state otherwise, you agree that your submitted content shall be in the public domain in all countries and territories, unless source quoted and posted under fair use. For any content that you post on TTH, you grant TTH a perpetual, irrevocable license to TTH to copy, reproduce, distribute, export, import, duplicate, modify, display, make available, perform, and any other type of usage, action, or embodiment now and forever recognized by any and all courts of competent jurisdiction.

Voluntary Deletion. If you elect to have your account deleted, all of your posts and comments will have the username changed to "Hades." All of your chatter and messages, even in other users inboxes will be deleted. Your account information, posts, comments, and records may reside on backups. If you have reserved any rights in your posts and comments, you will maintain those rights, but still grant TTH the license set forth in the paragraph above.

DMCA. By posting anything to TTH, you warrant that you have all necessary rights to be able to do so. Do not post content in violation of another's copyright. If any entity certifies that your post violates its copyrights in accordance with the Digital Millenium Copyright Act, access to that content will be disabled solely at the discretion of TTH until you certify in accordance with relevant counter notification procedures. Users that repeatedly post content in violation of copyright law will be subject to discipline as defined below in the Discipline section.

TTH reserves the right to prosecute false statements abusing DMCA takedown and counter-notification procedures.

CDA and other Non-Copyright Takedowns. In accordance with the Communications Decency Act, TTH does not and will not necessarily monitor communications made through this site. TTH makes no guarantee that any content posted in violation of any law other than copyright will be removed. You agree not to rely on any promise or statement by anyone purportedly to be from TTH regarding the removal of any content which you allege to be infringing any of your rights not related to copyright law.

Discipline

Willful and substantial violations of these terms may result in suspension of your account. Multiple violations will result in the indefinite suspension of your account. TTH reserves at it's sole discretion to determine whether a violation is willful and substantial. TTH reserves all rights, and nothing in this section constitutes any guarantee of procedure or rights in how your account suspension may be handled.

Miscellaneous

Updates. The terms of this agreement may be modified from time to time solely at the discretion of TTH. Your continued use of this site constitutes assent to these modifications. From time to time, TTH will notify you of substantial updates in this policy.

Choice of Law and Forum. Should any dispute arise between you and TTH, that dispute shall be litigated under the laws of the Southern District of Florida, United States. No court other than the Souther District of Florida, and competent appellate courts therefrom shall have jurisdiction, in the United States or in any other country.
